Privacy Policy
This Privacy Policy describes how Fast Ad Technologies LLC ("Company," "we," "us," or "our") collects, uses, discloses, and protects information in connection with the Company's corporate website located at [https://fastadtechnologies.com/], the Company's software application installed on the computer systems of salvage yard, automotive recycler, and used-parts dealer clients ("Dealers") (the "Application"), and related services (collectively, the "Services"). This Policy applies to visitors to the Company's corporate website ("Site Visitors"), and to Dealer owners, employees, and contractors who use the Application ("Dealer Personnel"). By using the Services, you acknowledge the practices described in this Policy.
Important scope note: the Company does not operate a public-facing marketplace or website through which consumers search for or purchase automotive parts. The Application is installed on a Dealer's own systems and transmits the Dealer's inventory and listing data to third-party websites or platforms that the Dealer selects ("Third-Party Sites"), which the Company does not own, operate, or control. With respect to any personal information transmitted through the Application in connection with a Dealer's listings or buyer inquiries (for example, a buyer's contact information relayed back to a Dealer), the Company acts solely as a service provider/processor on behalf of the Dealer, as further described in Section 4 and in the Company's Data Processing Addendum with each Dealer. A consumer's primary privacy relationship for a purchase is with the Dealer and/or the applicable Third-Party Site, not with the Company, and such consumers should consult the privacy policy of the Dealer or Third-Party Site involved in their transaction.
1. Information We Collect
1.1 Information You Provide
Account information: name, email address, phone number, business name, and billing information.
Listing and buyer-inquiry data: Part descriptions, photographs, VIN/vehicle data, pricing, and inventory records entered through the Application, and buyer contact or inquiry information that a Third-Party Site or buyer submits back to the Application in connection with a Dealer's listing. The Company does not process payments or store payment card information.
Communications: messages, inquiries, and support requests submitted to the Company or through the Site.
1.2 Information Collected Automatically
Device and usage data: IP address, browser type, device identifiers, pages viewed, referring URLs, and timestamps.
Cookies and similar technologies, as described in Section 3.
Approximate location derived from IP address, or precise location if you enable location services and consent to its collection.
1.3 Information From Third Parties
We may receive information from Dealers (e.g., when a Dealer enters a User's contact information for order fulfillment), payment processors, analytics providers, and marketing partners.
2. How We Use Information
To provide, operate, and maintain the Services, including enabling Dealers to manage Parts inventory and transmit listings to Third-Party Sites;
To comply with our tax, accounting, and recordkeeping obligations;
To communicate with you regarding orders, account activity, and customer support;
To detect, prevent, and investigate fraud, security incidents, and violations of our Terms;
To improve and develop the Services, including analytics and product development;
To send marketing communications, where permitted, and subject to your opt-out rights; and
To comply with legal obligations and enforce our agreements.
3. Cookies and Tracking Technologies
We and our service providers use cookies, web beacons, and similar technologies to operate the Site, remember preferences, analyze usage, and support advertising. You may control cookies through your browser settings; disabling cookies may affect Site functionality. We do not currently respond to browser "Do Not Track" signals.
4. How We Share Information
With the Dealer whose Application account collected or generated the information, and with the Third-Party Site(s) that Dealer has selected, to the extent necessary to transmit a listing or facilitate a buyer inquiry on the Dealer's behalf;
With service providers who perform functions on our behalf, including payment processing, hosting, analytics, customer support, and marketing, under contractual confidentiality and data protection obligations;
With professional advisors, including legal counsel and auditors;
In connection with a merger, acquisition, financing, or sale of assets;
To comply with legal process, government request, or to protect the rights, property, or safety of the Company, our users, or others; and
With your consent, or as otherwise disclosed at the time of collection.
We do not sell personal information for money. To the extent any sharing described above constitutes a "sale" or "sharing" under applicable state privacy law (e.g., for cross-context behavioral advertising), you may exercise the choices described in Section 6.
5. Data Retention
We retain personal information for as long as necessary to provide the Services, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements, after which it is securely deleted or de-identified.
6. Your Privacy Rights and Choices
Depending on your state of residence, you may have the right to: (a) request access to, or a copy of, the personal information we hold about you; (b) request correction of inaccurate information; (c) request deletion of your personal information; (d) opt out of the sale or sharing of personal information, targeted advertising, or certain profiling; and (e) not be discriminated against for exercising these rights. To exercise these rights, contact us using the information in Section 12 or, where available, use the in-Site mechanism described below. We will verify your request before responding, as required by law, and will respond within the time period required by applicable state law.
6.1 California Residents (CCPA/CPRA)
This Section applies to California residents and supplements the disclosures above, as required by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (collectively, the "CCPA"), to the extent the Company meets the CCPA's applicability thresholds.
Categories collected: identifiers (name, email, IP address, account credentials); commercial information (transaction and order history); internet/network activity (browsing and usage data); geolocation data (approximate, and precise where you consent); and, for Dealer Personnel, professional/employment-related information. We do not knowingly collect sensitive personal information beyond precise geolocation and account log-in credentials, and we do not use or disclose sensitive personal information for purposes requiring an additional right to limit under Cal. Civ. Code § 1798.121.
Purposes and retention: each category above is collected and retained for the business and commercial purposes described in Section 2 and for the retention periods described in Section 5.
Sale/sharing: we do not sell personal information for monetary consideration. To the extent our use of advertising or analytics cookies constitutes a "sale" or "sharing" (as those terms are defined under the CCPA, including for cross-context behavioral advertising), you may opt out at [OPT-OUT LINK / "Do Not Sell or Share My Personal Information"]. We honor opt-out preference signals, including the Global Privacy Control (GPC), as an opt-out request for the browser or device on which the signal is sent.
Your rights: you have the right to know/access, delete, correct, and opt out of sale/sharing or targeted advertising, and the right to non-discrimination for exercising any CCPA right. You may designate an authorized agent to submit a request on your behalf, subject to identity-verification requirements.
Shine the Light: California Civil Code § 1798.83 separately permits California residents to request information once per year about disclosures of personal information to third parties for their direct marketing purposes; we do not disclose personal information for third parties' own direct marketing purposes.
Metrics: consistent with CCPA regulatory requirements, we will disclose in this Policy, on an annual basis, aggregate metrics regarding requests received and our response times where applicable.
6.2 New York Residents
New York does not currently have a comprehensive consumer privacy statute comparable to the CCPA. New York residents' privacy is protected principally through the following New York laws, with which the Company complies:
Stop Hacks and Improve Electronic Data Security Act (SHIELD Act), N.Y. Gen. Bus. Law §§ 899-aa, 899-bb: we maintain a data security program with reasonable administrative, technical, and physical safeguards appropriate to the size and complexity of our operations and the sensitivity of the personal information we handle.
Breach notification, N.Y. Gen. Bus. Law § 899-aa: in the event of a breach compromising the security, confidentiality, or integrity of a New York resident's private information, we will notify affected individuals and, where required, the New York Attorney General, the Department of State, and the Division of State Police, in the most expedient time possible without unreasonable delay, consistent with the legitimate needs of law enforcement.
New York Child Data Protection Act: to the extent the Services are used by anyone the Company knows to be under 18, we do not use algorithmic/addictive design features or process such a user's personal data for targeted advertising without verifiable parental or age-appropriate consent, as required by law. The Services are not, however, directed to or intended for use by minors; see Section 7.
New York residents who wish to exercise the rights described in Section 6.1 above may also submit such requests to the Company; we will consider and respond to New York requests using the same process, as a matter of Company policy, even though not all such rights are currently mandated by New York statute.
6.3 Other States
Residents of Colorado, Connecticut, Virginia, Utah, and other states with comprehensive consumer privacy laws may have similar rights to access, correct, delete, and opt out of the sale of personal information, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects. Such residents may exercise these rights using the contact information in Section 12.
7. Children's Privacy
The Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child in violation of this Policy, we will delete such information.
8. Data Security
We implement administrative, technical, and physical safeguards reasonably designed to protect personal information from unauthorized access, use, or disclosure, consistent with the reasonable-security standard of the New York SHIELD Act and comparable state data-security statutes. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Third-Party Sites
The Application transmits Dealer listing data to Third-Party Sites selected by each Dealer, and the Company's corporate website may contain links to third-party websites. This Policy does not apply to, and the Company is not responsible for, the privacy practices of any Third-Party Site or other linked third-party website; we encourage you to review those practices independently.
10. International Data Transfers
If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
11. Changes to This Policy
We may update this Policy from time to time. Material changes will be indicated by an updated "Effective Date," and, where required by law, additional notice will be provided. Continued use of the Services after an update constitutes acceptance of the revised Policy.
